Brazil's antitrust tribunal ruled unanimously that the investment did not require mandatory notification.
The Tribunal of Brazil's Administrative Council for Economic Defense, known as Cade, decided on September 23, 2026, that the partnership between Amazon and Anthropic PBC does not require mandatory antitrust submission. The unanimous ruling clears the operation to take effect in Brazil without fines or regulatory restrictions.
The transaction includes a minority investment by Amazon in Anthropic through two convertible debt notes to expand generative artificial intelligence collaboration. Amazon stated to the regulator that the non-exclusive deal is pro-competitive, allowing Anthropic to maintain its independence, compete with well-funded tech peers, and pursue other backers such as Microsoft.
Reporting commissioner José Levi voted to close the administrative inquiry. He noted that despite deep cooperation, the deal lacks shared governance, a common budget, mixed teams, co-owned assets, or joint commercial goals that would constitute a joint venture. Cade president Diogo Thomson highlighted that the decision will serve as a precedent for future reviews in the artificial intelligence market.
