OpenAI asks US judge to dismiss xAI antitrust lawsuit

OpenAI asked a federal judge in Texas to dismiss before trial an antitrust lawsuit filed by Elon Musk's artificial intelligence startup, xAI. OpenAI argued that securities filings from SpaceX, the parent company of xAI, undermine claims that OpenAI's partnership with Apple harmed competition.

On September 22, 2026, OpenAI requested US District Judge Mark Pittman in Fort Worth to rule in its favor based on the evidence presented so far. The case is scheduled for trial in January.

Musk's companies sued Apple and OpenAI in 2025, claiming Apple violated antitrust law by exclusively integrating ChatGPT into Apple Intelligence features on iPhones and other devices. Apple and OpenAI have denied wrongdoing. Apple previously stated that its integration agreement was not exclusive, and X reached an undisclosed settlement with Apple.

In its court filing, OpenAI stated that the initial public offering registration statement of SpaceX, which began trading publicly in June, contradicted the claims of competitive injury in xAI's lawsuit. OpenAI also noted that the integration of ChatGPT on Apple devices had a slow start in early 2025, leading OpenAI to lower its weekly active user growth forecasts for the partnership.
